February 28, 1811 Cumberland Court On the motion of the legatees of James Dowdy, deceased, it is ordered that the ordered that the order entered by the clerk at November Court __?__directing the report of the commissioners appointed to settle the accounts of the Executors of James Dowdy, deceased, to the recorded, be recinded it appearing that the order under which the said commissioners were appointed to act was not fully executed and the said report is to await the return of said commissioners which shall be fully complied with the said order under which they act, that the whole subject may be examined to be approved or disapproved the court as the case may appear right, to which order Thomas Dowdy, one of the Executors, excepted and because he says the settlement was correct as appears of record no parole testimony being introduced. This Indenture made this seventh day of November one thousand eight hundred and eleven between Frances Dowdy (relict of James Dowdy, deceased, Richard Dowdy, James Dowdy, and Jesse Dowdy, sons of said deceased, all of the county of Cumberland of the one part and Jacob Bransford of the same county of the other part witnesseth that the said Frances, Richard, James and Jesse, for the consideration of the sum of seven hundred eighty two dollars thirty four cents lawful money of Virginia to them in hand paid by the said Jacob, the receipt of which is hereby acknowledged, hath bargained, sold , and confirmed and by these present do absolutely bargain, sell, and confirm unto the said Jacob Bransford and to his heirs and assigns forever, a certain tract of land lying in the aforesaid county of Cumberland, containing two hundred twenty nine acres be the same more or less, and bounded by the lands of the said Jacob Bransford, John Colquitt, Noton Goodman, little Guinea creek and the land of Lewis Isbell, it being the same the said James Dowdy, deceased, possessed of and where on the said Frances now resides to have and to hold, the said sold land with all the privileges and appurtenances there unto belonging or in any wise appertaining complete possession of said sold lands and to be given unto this said Jacob, his heirs and assigns, on or before the twenty fifth day of December, one thousand eight hundred and twelve with the privilege of sowing grain and fallowing land any time after first day of October one thousand eight hundred and twelve and this said Frances, Richard, and Jesse for themselves and their heirs and assigns do covenant and agree with the said Jacob to warrant and forever defend the right and title of said sold lands and against the claim or demand of all persons or any person whatsoever unto the said Jacob and to his heirs an assigns forever in testimony whereof the said Frances, Richard, James, and Jesse hath set their hand and affixed their seals the day and date above written.

On hearing the said bill answer And the will, and exhibits, the court doth decree that the said Executors deliver to the said Frances Dowdy, the widow, all the slaves and other personal property of the said testator, except what shall be otherwise appropriate by this decree, upon condition however that the said widow enter into bond of good security to be judged of by the court in a sufficient penalty to the said executor, to refund the said property to the executors in case any debts or future claims or demands shall come against the said executors or estate of said testator, and the court doth further order and decree that the said Executors deliver to the said Richard Dowdy, guardian of William Dowdy, the slave Morning and his increase, to hold as the property of said infant upon condition that the said guardian enters into bond of security as aforesaid to refund as aforesaid in the case of the widow to the executors if required. It appeared to the court that the said mare colt was delivered to James, by his confession in court, and the said testator Negro Funny was delivered of a child, which was delivered to Jesse Dowdy the nephew mentioned in the bill and will. It seems to the Court that the bill as to Thomas infant, need not to be acted on as he the infant has no present interest in the estate, or any interest that can be affected in this suit and this court is continued for the report of the commissioners.
